A MAN charged with criminal damage and possession of a weapon who has been trying to get his case dismissed has failed to attend court.
Waseem Malik, of Handover Way in Windsor, has been charged with criminal damage and possession of a stun gun in Windsor on December 8, 2020.
However, the 58-year-old has requested his case be dismissed, claiming the Crown has failed to provide proof that he is the defendant charged with the offences as well as providing sufficient evidence of the alleged incident.

He has previously refused to stand in the dock, as well as later refusing to enter a courtroom resulting in him almost being arrested.
As a result, resident Judge Heather Norton scheduled a half-day hearing for Monday, September 11 to establish the identity of the defendant as well as if there are grounds to dismiss the case in favour a Section 36 – which encourages parties to settle disputes without going to trial.
However, Malik failed to attend the hearing and a warrant not back for bail was issued.

The case at present is still proceeding to trial on April 8 next year. The next hearing for mention is scheduled to take place on October 12.
