A MATURE willow tree was almost cut down in error last week.
Residents and Maidenhead councillor Phil Haseler worked quickly to stop the tree in Cox Green from being felled.
The branches of the tree between Lambourne Drive and Cox Green Road had already been stripped back on Monday, August 2 and the tree was close to being fully cut down.
It turns out the plot of land is adopted highway meaning the council has responsibility for it and the sub soil is owned by a third party.
When the plots are sold by third party owners the owners of the land cannot carry out any work to anything above the soil, including the willow tree.
Cllr Haseler was on-site to speak with the tree surgeon. Cllr Haseler said he spoke with the person overseeing the felling and after checking the location, informed them they could be committing an offence of criminal damage if they continue further.

Cllr Haseler informed residents on Facebook and said: "A sharp eyed Resident called me to report that the mature Willow tree was being felled at the location. I was at work, downed tools and attended the location.
"This morning I had a long conversation with the Tree Surgeon and I asked him to stop the work as he may be committing an offence of Criminal Damage. The matter will now be investigated and involve a legal process, so I’ll not comment further."
Royal Borough of Windsor and Maidenhead Council also explained they would be inspecting the tree to assess the damage.

A council spokesperson said: “The council is aware that unauthorised tree works took place at this location which have now been stopped.
"Our tree officers will now be inspecting the tree to assess the damage and then consider next steps.”
